Miles, Sears & Eanni attorney Christopher Watters recently reached a $515,000 settlement in the personal case H. Andrew Weldon v. Ray Martin Harrod filed in Monterey County.
Mr. Weldon was struck by the defendant driver’s truck while crossing the street in a marked crosswalk with an illuminated walk sign. He sustained injuries to his lumbar spine, which ultimately necessitated surgical intervention. Mr. Weldon underwent L4-S1 lumbar decompression and fusion.
The defense admitted liability, but disputed Mr. Weldon’s claim for future non-economic damages. The defense contended that Mr. Weldon’s surgery was a success, and he recovered well with only minimal residual complaints. The defense highlighted Mr. Weldon’s age of 70 years and his pre-existing health issues as further support for the argument that his future damages should be limited.
The parties reached the settlement on November 21, 2018.
