Lyndsie Russell Secures Settlement in Medical Malpractice Case Involving Death of Full-Term Baby

Lyndsie N. Russell of Miles, Sears & Eanni successfully represented Jane Doe and John Doe in a medical malpractice case against Roe Hospital and Roe Nurse following the tragic death of their full-term baby. This case involved serious lapses in medical care during the labor and delivery process that led to the infant’s death despite efforts to resuscitate.

The case unfolded when Jane Doe presented to Roe Hospital after her water broke, where she was triaged and admitted. Although multiple signs of fetal distress were noted—including minimal fetal heart rate variability, late decelerations, and the presence of meconium in the amniotic fluid—these critical issues were not communicated to the attending physician in a timely manner.

Despite the warning signs, including the baby’s decreased movement, Roe Nurse failed to inform the attending physician of the deteriorating condition. As a result, the infant’s fetal heartbeat was lost for 15 minutes before an ultrasound revealed there was no heartbeat. Tragically, the baby was delivered stillborn after an emergency caesarean section, and despite extensive resuscitation efforts, the infant did not survive.

Through Lyndsie N. Russell’s diligent representation, the case settled for $405,000 for the grieving parents. This case underscores the importance of proper communication and prompt medical action in preventing fatal outcomes.
