Miles, Sears & Eanni attorney Richard Watters recently reached a $1 million settlement for auto accident victims in the case of Kisling v. Mink Trucking & Excavation.
Christopher and Deanna Kisling were driving his restored 1949 Ford Coupe with lap belts only in the vehicle. They were proceeding northbound on Academy Avenue with no traffic control when a dump truck pulling a trailer, owned by Gary Mink and operated by Justin Mink, pulled from the stop sign and hit the driver’s side of the Ford. This caused the driver’s door to pop open and both Mr. and Mrs. Kisling fell out of the car sustaining traumatic brain injuries.
The defense contended that the Kislings were not wearing the available lap belts and had they been worn their serious TBIs would have been avoided.
Plaintiffs made Code of Civil Procedure Section 998 policy-limits demand in the amount of $500,000 for each plaintiff which were accepted the 998s, ending the case with a $1 million settlement.
