Miles, Sears & Eanni attorney Christopher C. Watters recently reached a $1 million settlement for a traffic accident victim in the underinsured motorist case of Michael Grays v. Philadelphia Insurance Companies. Mr. Grays was severely injured at the intersection of Old Bayshore and North 10th Street in San Jose when the third party driver, Shubha Ramachandrappa, made a left turn into his work van.
Mr. Grays, the traffic accident victim, sustained a low back injury resulting in chronic lower back pain with occasional radicular symptoms in his lower extremities. As a result, he has been unable to return to work as an HVAC service technician.
The defense contended that Mr. Grays’ low back condition was due to his pre-existing degenerative disc disease, and that he could return to work in some capacity.
The parties reached a $860,769.00 settlement on May 17, 2016. The total settlement amounted to $1,000,000.00 policy limits, minus workers’ compensation and third party credit. Philadelphia Insurance Companies was entitled to a credit for the $100,000.00 third party settlement for the single person policy limits with Allstate Insurance Co., and the $39,231.00 credit for the workers compensation benefits Mr. Grays received.
