Miles, Sears & Eanni attorney Richard Watters reached a $22.6 million settlement in the personal injury case Doe v. Doe Utility Company in Madera County.
On May 6, 2002, the plaintiff was driving a van for the school district she worked for in Madera. A vehicle being driven by an employee of Doe Utility Company ran a stop sign striking plaintiff’s vehicle. The plaintiff was ejected from her vehicle and ultimately rendered a tetraplegic.
Following the accident, the plaintiff spent four months in the hospital, including three months in a Colorado rehabilitation hospital. She underwent two neck surgeries and now requires 24-hour attendant care.
The defense, Doe Utility Company, argued that the driver of their company vehicle was not within the course and scope of his employment at the time of the accident. The defense further disputed the amount of the plaintiff’s life care plan.
The parties reached a settlement of $22.6 million, $22.5 million from Doe Utility Company and $100,000 from an insurance policy.
