Miles, Sears & Eanni attorney Richard Watters represented Andie Calderon, Ashley Calderon, Gissel Barraza, Claudia Calderon, Diane Montes, and Guillermo Montes in a personal injury case involving a multi-vehicle collision that occurred on May 23, 2002.
A driver for Velocity Express Intermountain, Inc. crossed over the center line of Highway 180 striking two vehicles carrying members of the same family. Three people died, including the adverse driver, as a result of the collision and numerous others suffered injuries, including but not limited to, traumatic brain injuries, numerous fractures, and emotional injuries.
Two trials were completed in this case. A court trial was completed by MSE attorney William Seiler to determine whether Velocity had a joint venture with other defendants. After the court found for plaintiffs, MSE attorney Richard Watters began the jury trial portion. Defendants admitted liability, but disputed the amount of damages.
After a nineteen day trial, the jury returned a verdict of $14,300,000 for plaintiffs. However, based on an agreement between parties before the trial began, defendants paid $15,000,000.
